- Wrongful death: When a victim dies because of the injury they sustained, the law allows the family or other representative to file a wrongful death claim against the at-fault party. In addition to the types of damages the victim could have received in personal injury lawsuit if they had survived, compensation in a wrongful death lawsuit can also include many other damages. This includes funeral and burial expenses, loss of the benefits and future income the victim would have provided for their family, loss of services the victim provided for their family, and the loss of companionship and guidance the victim provided to his or her loved ones.
